The study first briefly reviews the history of ecclesiastical legislation on this prohibition from the early Church up to the 1983 Code. The second part surveys developments from the 1917 Code to the 1983 Code, in particular the 1950 Decree Pluribus ex documentis, pertinent texts of Vatican II, and the iter of canon 286 in the Code revision process. The third part is an analysis of the text of canon 286 and a discussion of its implications for clergy and religious. The final part treats the practice of commerce or trade as an impediment to ordination and the violation of the prohibition of canon 286 as a delict subject to penalty. L’Article examine la signification et l’application pratique du canon 286 du Code de droit canonique qui interdit au clergé de s’engager dans le commerce ou les affaires sans l’autorisation d’une autorité légitime. L’étude passe d’abord brièvement en revue l’histoire de la législation ecclésiastique sur cette prohibition depuis l’Église primitive jusqu’au Code de 1983. La deuxième partie passe en revue les développements apportés au Code de 1917 jusqu’au Code de 1983, en particulier le Décret Pluribus ex documentis de 1950, les textes pertinents de Vatican II et l’iter du canon 286 dans le processus de révision du Code. La troisième partie est une analyse du texte du canon 286 et une discussion de ses implications pour le clergé et les religieux. La dernière partie traite de la pratique du commerce ou des affaires comme un obstacle à l’ordination et la violation de l’interdiction du canon 286 comme un délit passible d’une peine. |
