Abstract :

(1) Sexual abuse is a crime, not a trivial offense.
(2) Abuse occurred and occurs in all social classes, organisations, most frequently in the family environment.
(3) This article does not focus on the phenomenon as a whole, but on the crime within the Catholic Church.
(4) A society or church that bashfully proclaims the dealing with this offense to be improper or ominous, favours this crime through cover-up.
(5) Since abuse is a crime, it is not just ecclesiastical courts that have to deal with it, but also the state jurisdiction.
(6) The Pope’s recommendation in October 2018, 'If you see such a thing, report immediately to the bishop! To help this brother-offender – report immediately to the bishop!' is therefore to be rejected. The issue is, first and foremost, NOT TO HELP THE OFFENDER BUT TO STOP HIM AND RELEASE THE VICTIM FROM HIS HANDS, then to make the emergency call to the police and – only then – to notify the bishop.
(7) The abuse of power and conscience must be ostracised in the church, as it provides the breeding ground for sexual abuse (as Pope Francis said!).
(8) It is improper to identify homosexuality as a cause of abuse, and thus designate voluntary sexual relations between adults on a par with a crime.
(9) Nor is celibacy seen as causally related to abuse. However, given the extent of abuse carried out by priests, their symbolism in today’s world should be reflected, and seminaries should take the necessary precautions to ensure that compulsory celibacy does not attract sexually immature and misguided men to the priesthood.
(10) The Catholic Church needs to re-think and re-evaluate its understanding of sexuality and gender relations, and consequently change its legal regulations. It is high time that the Pope not only denounced human rights violations on a continuous basis, but also finally signed the human rights declaration as the VATICAN HEAD-OF-STATE and declared it binding within the church.
