Document Details : Title: De toepassing van de sharia binnen de wettelijke kaders van de Nederlandse rechtsstaat Author(s): MURADIN, Arshad Journal: Tijdschrift voor Theologie Volume: 60 Issue: 1 Date: 2020 Pages: 37-60 DOI: 10.2143/TVT.60.1.3287412 Abstract : In the contemporary Netherlands, with its ever-growing anti-Islamic sentiments, a significant part of the Muslim population indicates that their faith forms an important part of who they are. Their religious identification is, among other things, determined by the possibility of following religious precepts within the legal framework and by their reaction to an environment that is largely secular. In an attempt to clarify the position of the sharia in the Netherlands, this contribution addresses the way in which Islam and Muslims have become part of Dutch society. By way of introducing Islam, some central ideas are explained that unite all Muslims, for example Islamic doctrine (‘aqida) and ritual purity (tahara). The main theme of this contribution is the significance Dutch Muslims attach to the term sharia to come to a more practical application of it in daily life, as is the case with the observance of religious precepts concerning fasting, circumcision, halal food and clothing, but also religious marriage and divorce. |
