Protecting these rights should be understood as a function of good governance. This study examines the conditions under which petitions and hierarchical recourses can be undertaken in current canonical discipline, identifies the technical barriers to taking them forward successfully, explains how they are treated in the Roman Curia and argues, in conclusion, that Pastors benefit from interpreting petitions and recourses primarily as an expression of the co-responsibility of the faithful rather than as a challenge to episcopal authority. Le droit canonique permet aux fidèles d’exprimer leurs besoins à ceux qui gouvernent l’Église, et de chercher la révision de décisions prises par leurs Pasteurs. La protection de ces droits doit être comprise parmi les fonctions d’un bon gouvernement. Cet article étudie les conditions pour entreprendre une pétition ou un recours hiérarchique selon la discipline canonique en vigueur, identifie les barrières techniques à leur poursuite réussie, explique leur traitement au sein de la Curie romaine et, en conclusion, argumente qu’il convient aux Pasteurs de comprendre ces pétitions et recours tout d’abord comme une expression de la coresponsabilité des fidèles plutôt que comme un défi à l’autorité épiscopale. |
