Yet, it does not specify every detail of their design, construction, or location. Such legislative silence might be thought to open the door to a certain creativity, but it has long been the case that the law on ecclesiastical furnishings has relied on unwritten norms, continuous practice, and longstanding Tradition, for its proper implementation. This article discusses the present canonical discipline of the Latin Church regarding the place of baptism in the Roman Rite, and offers an approach to lacunae that seeks to be consistent with the principles of interpretation common to the entire canonical legal tradition, of greater integrity than a narrow reading of the mere letter of the liturgical norms otherwise provides, is sensitive to the liturgical tradition of the Roman Rite – including the reforms of the Second Vatican Council and the rites emanating therefrom – and objective in scope, thereby minimizing the place for novelties that may disturb, displace, or damage, what it is that the Church understands about the sacrament of baptism, and which she duly seeks to present in her liturgical-sacramental rites. La droit liturgique actuelle sur le baptistère et les fonts baptismaux dans le rite romain met en oeuvre les réformes liturgiques du Concile Vatican II. Cependant, elle ne précise pas tous les détails de leur conception, de leur construction ou de leur emplacement. On pourrait penser qu’un tel silence législatif ouvre la porte à une certaine créativité, mais il y a longtemps que la droit sur le mobilier ecclésiastique s’est appuyé sur des normes non écrites, une pratique continue et une tradition de longue date pour sa mise en oeuvre correcte. Cet article examine la discipline canonique actuelle de l’Église latine concernant la place du baptême dans le rite romain et propose une approche des lacunes qui cherche à être cohérente avec les principes d’interprétation communs à l’ensemble de la tradition juridique canonique, d’une plus grande intégrité qu’une lecture étroite de la simple lettre des normes liturgiques ne le permet, est sensible à la tradition liturgique du rite romain – y compris les réformes du Concile Vatican II et les rites qui en découlent – et a une portée objective, minimisant ainsi la place des nouveautés qui peuvent perturber, déplacer ou endommager ce que l’Église comprend à propos du sacrement du baptême, et qu’elle cherche dûment à présenter dans ses rites liturgiques et sacramentels. |
