Alors que le texte est daté simplement par le mois et l’indiction, Schilbach proposa, avec beaucoup de réserves, la date de juin 1398. Toutefois, plusieurs considérations de type historique et paléographique conduisent à corriger cette chronologie et à la situer trente ans auparavant, en 1368, soit sous le règne de l’empereur Jean V Palaiologos. Cette nouvelle datation coïncide avec d’autres changements dans le système notarial et, plus généralement, sur le mode de fonctionnement des tribunaux de l’Empire qui permettent de mieux comprendre le contexte dans lequel fut délivré cet important document. In 1968, Erich Schilbach published and provided commentary on a fundamental document for understanding how the judicial system of the Byzantine Empire functioned during the late Palaiologan era: the regulation or hypotypôsis for the General Judges of the Romans. Whereas the text is dated only by month and indiction, Schilbach cautiously proposed the date of June 1398. However, a range of historical and palaeographic considerations now suggest a significant revision of this chronology, situating the document thirty years earlier, in 1368, during the reign of Emperor John V Palaiologos. This revised dating aligns with broader transformations in the notarial system and, more generally, with changes in the functioning of the Empire’s courts, thereby shedding new light on the context in which this key document was promulgated. |
