Abstract :
Canon 290 succinctly expresses three ways in which a cleric could 'lose the clerical state' (statum clericalem amittit). Nonetheless, given the complexity of the theological and canonical issues connected to 'loss of the clerical state', the interpretation and application of the canon’s three provisions are correspondingly complex. This article provides an interpretation of canon 290 and also relates the canon’s provisions to papal emendations of the law, other papal as well as curial documents, dispensations and faculties granted by the pope to the Congregation for the Doctrine of the Faith and the Congregation for the Clergy, and curial praxis. Through this analysis, the author provides a systemic overview of the current law and praxis on 'loss of the clerical state'.



Le canon 290 distingue trois façons dont on peut dire d’un clerc qu’il «perd l’état clérical» (statum clericalem amittit). Néanmoins la complexité des questions théologiques et canoniques liées à la «perte de l’état clérical» est telle que l’interprétation et l’application des trois dispositions du canon en question ne sauraient manquer d’être semées d’embûches et de difficultés. En plus d’offrir une interprétation du Canon 290, cet article établit des liens entre ses dispositions et des amendements pontificaux du droit, d’autres documents pontificaux ou émanant de la Curie, des dispenses et facultés accordées par le pape à deux congrégations (la Congrégation de la doctrine de la foi et la Congrégation du clergé), ainsi que la pratique curiale. Au fil de cette analyse, l’Auteur nous offre un survol systémique du droit et de la pratique actuels en matière de «perte de l’état clérical».
