Zij telt 16 leden (en 16 plaatsvervangende leden), is samengesteld uit 8 artsen en 4 andere zorgverleners, bijgestaan door 4 juristen. De commissie heeft vooral als taak na te gaan of de aangegeven euthanasiegevallen (via het door haar ter beschikking gestelde registratiedocument) uitgevoerd werden onder de wettelijke voorwaarden en procedurele vereisten. De commissie fungeert dus als buffer tussen de artsen en het gerecht, en enkel bij twijfel kan de commissie bij tweederde meerderheid beslissen een bepaald dossier te verwijzen naar de procureur des Konings. Hiernaast moet de commissie om de 2 jaar een statistisch verslag betreffende de euthanasiepraktijk opstellen en eventueel aanbevelingen formuleren die tot een wetgevend initiatief of tot andere maatregelen inzake de uitvoering van deze wet kunnen leiden. The Federal Committee of Control and Evaluation regarding Euthanasia The Federal Committee of Control and Evaluation regarding Euthanasia ("committee") was instituted according to the law on euthanasia. Sixteen members (and 16 deputy members) are on the committee, which consists of 8 physicians, 4 health providers and 4 lawyers. The main task of the committee is to evaluate if the registered cases of euthanasia (on a registration document devised by the committee) were carried out according to the legal regulations and procedural requirements. As such, the committee may be considered as a buffer between doctors and the court. Only if there is any doubt within the two-third majority, the questionable file will be referred to the attorney. Every two years, the committee is also expected to report statistical data and to formulate recommendations for a possible improvement of the legislation on euthanasia and/or its application. |
