Abstract :
İbrahim Hakkı’s History of International Law was the first Ottoman history of international law. While he was largely indebted to Henry Wheaton’s book, he introduced many original arguments. According to him, the Ottomans had been a member of the European state system since the 1606 Zsitvatorok treaty. He criticized the way in which the European Powers had treated the Ottomans, especially through the abuse of Capitulations and unjust interventions. In addition, his legal knowledge helped him evaluate Islamic as well as Ottoman figures according to the standard of the sovereign state system. He was critical of the past Ottomans because they granted 'too many' privileges to foreigners, an act that damaged the sovereignty of state. His legal approach secularized the legitimacy structure of the Ottoman Empire.



La première histoire ottomane du droit international est l’Histoire du droit international d’İbrahim Hakkı (Tarih-i hukuk-ı beyneddüvel). Tout en se fondant largement sur l’ouvrage de Henry Wheaton, İbrahim Hakkı introduisit nombre d’arguments originaux. Selon lui, les Ottomans faisaient partie du concert des États européens depuis le traité de Zsitvatorok de 1606. Il critiquait la façon dont les puissances européennes avaient traité les Ottomans, notamment par un usage abusif des capitulations et par des interventions injustes. De plus, ses connaissances juridiques lui permettaient d’évaluer les cas islamique et ottoman d’après les standards du système des États souverains. Il critiquait les anciens Ottomans pour avoir accordé trop de «privilèges» aux étrangers, ce qui avait eu pour conséquence d’affaiblir la souveraineté de leur État. Son approche juridique sécularisait la légitimation de l’Empire ottoman.
